South Dakota DMV Online Title Complaint System Expands Consumer Protection

South Dakotans experiencing problems with the documents used in vehicle sales can now use their computers to file written complaints with the state Department of Revenue and Regulation, Division of Motor Vehicles.

The division's Internet-based Online Title Complaint System became available to the general public November 13, 2006. The system was recommended by Governor Rounds' Motor Vehicle Consumer Protection Task Force and allows individuals to submit written complaints regarding the appropriate handling of titles or contracts related to the sale of titled vehicles or boats electronically.

According to Debra Hillmer, director of the Division of Motor Vehicles, complaints may be filed against dealers, businesses or individuals as long as the complaint is valid and involves a title or contract related to a vehicle or boat sale.

"While we recognize that we may see a few invalid complaints, those complaints that are valid and fall within our authority will be resolved within the confines of state law," said Hillmer.

Anyone with an Internet connection can access the complaint system to complete and file an online complaint form. Complaints which are warranty or service contract-based will be sent directly to the Division of Consumer Protection; all others will be handled by the Division of Motor Vehicles.

Individuals not having Internet access or not comfortable submitting such forms online may still file paper complaints. Complaint forms are available from their local county treasurer's office or the Division of Motor Vehicles in Pierre. Complaint forms are also available for downloading.
