The lawsuit was filed by Maryland resident Ross Hecox, who subscribes to DoorDash’s DashPass paid subscription service, and his sons. Their chief complaint is against DoorDash’s “expanded range fees,” which adds additional fees on orders placed with restaurants that are outside a certain range around the order’s delivery address.
According to the lawsuit, tests revealed that two identical orders placed at the same time, from the same restaurant, to be delivered to the same address, yielded a lower price for the one placed on an Android than the one on an iPhone.
A DoorDash spokesperson refuted these claims in a statement toGizmodo: “The claims put forward in the amended complaint are baseless and simply without merit. Our priority is to provide the best service possible and ensure there is clarity for consumers that allows them to make informed decisions. We ensure fees are disclosed throughout the customer experience, including on each restaurant store page and before checkout. Building this trust is essential, and it’s why the majority of delivery orders on our platform are placed by return customers. We will continue to strive to make our platform work even better for customers, and will vigorously fight these allegations.”
